1. About us
This website, legacytableware.co.uk, is run by Legacy Silverware, trading as Legacy Tableware (“we”, “us”, “our”). Legacy Silverware also operates legacysilver.co.uk.
- Address: Nimrod Works, 33 Trinity Street, Sheffield, S3 7AJ
- Email: hello@legacytableware.co.uk
- Phone: 01629 640965
These terms apply to every order placed through this website. Please read them before you order. By placing an order you agree to them. If you’re buying as a consumer, nothing in these terms affects your statutory rights.
2. Who these terms apply to
We sell to both:
- Consumers: individuals buying wholly or mainly for personal use, outside their trade or business.
- Business customers: restaurants, hotels, caterers and other businesses buying for use in their trade.
Some sections apply only to one or the other, and say so. If you’re a business customer, section 13 also applies to you.
3. Products and descriptions
We aim to describe and photograph every product accurately. Colours can vary between screens, and handmade, reactive-glaze and stoneware items can vary slightly in colour, finish and size from piece to piece. That variation is part of the product and isn’t a fault.
Sizes and capacities are given as a guide. If an exact dimension matters to you, please contact us before ordering.
Products are for the use described. Please follow any care instructions, including guidance on dishwasher, microwave, oven and freezer use.
4. Prices
Prices are shown in pounds sterling and include VAT at the current rate unless stated otherwise. Delivery charges are added at checkout.
We check prices regularly, but errors can happen. If we discover a pricing error after you’ve ordered, we’ll contact you and give you the choice of going ahead at the correct price or cancelling for a full refund. We’re not obliged to supply goods at a price that is obviously wrong.
5. Placing an order
When you place an order you’ll receive an email acknowledging it. This isn’t acceptance. A contract between us is formed when we email to confirm your order has been dispatched.
We may decline an order, for example if a product is out of stock, a price is wrong, or we suspect fraud. If we do, we’ll tell you and refund any payment in full.
You must be 18 or over to place an order.
6. Payment
Payment is taken in full at checkout through our secure payment providers. We never see or store your full card details. Payment must be received before goods are dispatched, unless you hold an approved trade credit account (see section 13).
7. Stock and availability
All orders are subject to availability. Many of our products come from third-party manufacturers, and stock levels can change. If an item becomes unavailable after you order, we’ll let you know and either offer an alternative or refund you for that item.
8. Delivery
Delivery options, costs and estimated timescales are shown at checkout and on our Delivery & Returns page. Delivery times are estimates, not guarantees.
Risk in the goods passes to you when they are delivered to the address you gave us. Ownership passes to you once we’ve received full payment.
If you’re not available to take delivery, the courier will usually leave a card or try again. If goods are returned to us because delivery fails, we may charge you the cost of re-delivery.
Overseas orders: we mainly deliver within the UK. We may accept orders from outside the UK case by case. Any import duties, taxes or customs charges are your responsibility.
9. Damaged, missing or incorrect items
Please check your order when it arrives. Tableware and glassware are fragile, so if anything is damaged, missing or not what you ordered, please tell us within 3 working days of delivery, with photos of the item and packaging where possible. Keep all packaging until we’ve resolved the issue.
Telling us quickly helps us claim from the courier and sort things out faster. If you’re a consumer, this doesn’t affect your statutory rights under section 11.
10. Your right to cancel (consumers only)
Under the Consumer Contracts Regulations 2013, if you’re a consumer you can cancel your order for any reason within 14 days of the day you (or someone you nominate) receive the goods.
How to cancel: complete the returns request on our website, or email hello@legacytableware.co.uk with your name, order number and the items you’re returning. Wait for us to confirm return details before sending anything.
Returning the goods: send them back within 14 days of telling us you’re cancelling, to:
Legacy Silverware
3 Edge View Drive
Great Longstone
Near Bakewell
Derbyshire
DE45 1PB
Unless the goods are faulty or we sent the wrong item, you pay the cost of returning them. Please pack items carefully, as you’re responsible for the goods until they reach us.
Refunds: we’ll refund you within 14 days of receiving the goods back (or proof you’ve sent them), using the payment method you used to order. If you cancel your whole order, we’ll refund the price of the goods and our standard delivery charge. If you chose a more expensive delivery option, we’ll only refund the cost of standard delivery.
Condition of returned goods: goods should be returned unused and in their original packaging. If items are returned damaged, used beyond what’s needed to inspect them, or with missing packaging, we may reduce your refund to reflect the loss in value.
Exceptions: the right to cancel doesn’t apply to goods made to your specification or clearly personalised, such as engraved or bespoke items, unless they’re faulty.
11. Faulty goods (consumers)
The Consumer Rights Act 2015 says goods must be as described, fit for purpose and of satisfactory quality. If they’re not, you’re entitled to:
- a full refund if you tell us within 30 days of delivery;
- a repair or replacement if you tell us after 30 days, or a refund or price reduction if a repair or replacement isn’t possible or doesn’t fix the problem;
- in some cases, a remedy up to six years after delivery.
We’ll cover the reasonable cost of returning faulty goods. Normal wear and tear, damage from misuse, accidents or not following care instructions are not faults.
12. Our liability (consumers)
If we break these terms we’re responsible for loss or damage you suffer that is a foreseeable result of that. We’re not responsible for loss that wasn’t foreseeable when the contract was made.
We supply products for domestic and private use. If you’re a consumer, we’re not liable for any loss of profit, loss of business or business interruption.
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything that can’t be limited by law.
13. Trade and business customers
This section applies if you buy in the course of a business.
- Trade accounts: we may offer trade pricing or credit terms at our discretion. Any agreed account terms will be confirmed in writing and apply alongside these terms.
- Returns: the 14-day cancellation right in section 10 doesn’t apply to business customers. We may accept returns of unused, resaleable stock at our discretion, and may charge a restocking fee.
- Damaged or missing goods: claims must be made within 3 working days of delivery. We may refuse claims made after that.
- Bulk and special orders: items ordered specially from a manufacturer for you may not be cancelled or returned once ordered, unless faulty.
- Warranties: we’ll replace or refund goods that are faulty on delivery. Beyond that, and to the extent allowed by law, all implied terms are excluded.
- Liability: our total liability to a business customer for any order is limited to the price paid for that order. We’re not liable for any indirect or consequential loss, loss of profit, revenue or business, or loss arising from breakage in commercial use.
- Late payment: for credit accounts, we may charge interest and compensation under the Late Payment of Commercial Debts (Interest) Act 1998 on overdue invoices.
14. Events outside our control
We’re not responsible for delays or failure to perform caused by events beyond our reasonable control, such as courier disruption, supplier shortages, severe weather or industrial action. If this happens we’ll tell you as soon as we can, and you can cancel and receive a refund for anything not yet delivered.
15. Using our website
The content, images, text and design on this website belong to us or our licensors. You may view and print pages for personal use, but you may not copy, reproduce or use them commercially without our written permission. Brand names and trademarks shown belong to their respective owners.
We try to keep the site available and accurate but can’t guarantee it will always be uninterrupted or error-free. Links to other websites are provided for convenience, and we’re not responsible for their content.
16. Your personal information
We use your personal information only as set out in our Privacy Policy.
17. Changes to these terms
We may update these terms from time to time. The version in force when you place your order is the one that applies to it.
18. Complaints
If you’re unhappy with anything, please contact us at hello@legacytableware.co.uk or on 01629 640965, and we’ll do our best to put it right.
19. Law and jurisdiction
These terms are governed by the law of England and Wales. Disputes may be brought in the courts of England and Wales. If you’re a consumer living in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
